Half of Adults Still Don’t Have a Will in Place – Why It’s Time to Take Action

Will stats

A recent national survey has revealed that over half of adults still do not have a Will in place. Despite one in three people saying they plan to write one, many continue to put it off. The research, based on responses from 2,000 adults, shows that 54% of people across all age groups have not made a Will, leaving their families potentially unprotected when the time comes.

Even among those aged between 55 and 64, 39% admitted they have not written a Will. This finding is particularly worrying, given that this is an age group where many will already have children, property, or other significant assets.

Why People Delay Writing a Will

At APT Legal, we regularly see the consequences of delayed decision-making when it comes to estate planning. Many people assume a Will is something they can deal with “later” or believe that it only becomes relevant at a certain age. Others feel uncomfortable discussing what happens after they pass away.

Yet, a Will is not just a legal document. It is an act of care. It ensures that your loved ones are looked after and that your wishes are respected. Without one, your estate is distributed according to the laws of intestacy, which may not align with what you would have wanted.

When a person dies without a Will, families can face delays, unexpected costs, and emotional distress while trying to settle the estate. Relationships can become strained, and what could have been a straightforward process often turns into a complicated one.

Probate Times Improving, But Delays Still Common

The same survey also looked at probate and inheritance experiences. Of the respondents, 45% had been named as beneficiaries in a Will, and many reported long waits to receive their inheritance. On average, people waited around 5.78 months.

Although recent data from the Probate Registry shows that grants of probate are now being issued in roughly half the time compared to early 2024, the process can still feel slow and confusing for families dealing with grief.

Probate is a vital legal step that gives someone the authority to administer a person’s estate after death. Even when everything is in order, it can take several months for the estate to be fully distributed. If documents are missing or if there are questions about the validity of a Will, the process can take even longer.
